Cody Marketplace Copyright and DMCA Policy
DRAFT, not reviewed by counsel.
Last updated: October 25, 2026
Cody Reading Inc. ("Cody," "we," "us") respects the intellectual property rights of others and expects users of Cody Marketplace (the "Services") to do the same. This policy explains how to report material on the Services that you believe infringes your copyright, how users can respond, and what we do about repeat infringement. It is part of our Terms of Service.
We respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act, 17 U.S.C. § 512 (the "DMCA").
1. Designated Agent
Send copyright notices and counter-notices to our designated agent:
Copyright Agent
Cody Reading Inc.
2810 North Church Street, PMB 936381
Wilmington, DE 19802
United States
Phone: (508) 203-1115
Email: copyright@codyreading.com
Only copyright notices and counter-notices should be sent to this address. Other questions go to support@codyreading.com.
2. Reporting Infringement
If you believe material on the Services infringes a copyright you own or control, send our agent a written notice that includes:
- your physical or electronic signature, as the copyright owner or a person authorized to act for them;
- a description of the copyrighted work you claim has been infringed (or, if several works are covered by one notice, a representative list);
- the specific location of the material you claim is infringing, such as the URL of each resource or shop page, in enough detail for us to find it;
- your name, mailing address, telephone number, and email address;
- a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- a statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.
A notice that does not substantially include these items may not be acted on.
The "Report this resource" link on each resource page is a quick way to tell us about a problem, but a report sent that way is not a DMCA notice. To send a DMCA notice, write to our designated agent.
Be accurate. Under 17 U.S.C. § 512(f), anyone who knowingly makes a material misrepresentation that material is infringing may be liable for damages, including costs and attorneys' fees. If you are unsure whether material infringes your copyright, consider consulting an attorney first. Please consider whether the use may be a fair use before sending a notice.
3. What Happens After a Notice
When we receive a valid notice, we will:
- remove or disable access to the material, by taking the resource off sale and disabling downloads of the identified files, including for Buyers who already obtained them;
- tell the Seller who posted it, and send them a copy of the notice, including the complaining party's name and contact information so the Seller can respond;
- record the notice against the Seller's account for our repeat infringer policy (Section 6).
While we review a notice, we may hold payouts for sales of the material, subject to applicable law and payment-provider rules. If we refund Buyers of removed material, the full order is refunded, the Seller's share is reversed, and Cody returns its fee for that order, as described in Section 12 of our Terms of Service. A copyright removal ends download access for prior Buyers unless the material is restored under Section 4; ordinary unpublishing by a Seller does not by itself end existing Buyers' licenses.
4. Counter-Notices
If material you posted was removed or disabled and you believe this happened because of a mistake or misidentification, you may send our agent a written counter-notice that includes:
- your physical or electronic signature;
- identification of the material that was removed or disabled and the location where it appeared before removal;
- a statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
- your name, address, and telephone number; and
- a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Cody may be found), and that you will accept service of process from the person who sent the original notice or their agent.
When we receive a valid counter-notice, we will promptly send a copy to the person who sent the original notice and tell them that we will restore the material in 10 business days. We will replace or restore access to the removed material, including Buyers' downloads, not less than 10 and not more than 14 business days after we receive a valid counter-notice, unless our designated agent first receives notice that the complaining party has filed an action seeking a court order to restrain the alleged infringement. We may keep material unavailable for a separate, independently applicable violation of our Terms, but will not characterize that decision as a DMCA restoration decision.
The same penalties for knowing material misrepresentation in Section 2 apply to counter-notices.
5. Imported Stores and Ownership Disputes
Cody Marketplace lets Sellers import listings from their own stores on other marketplaces. If you believe someone has imported your store or your resources into a Cody shop that is not yours:
- if your copyright is infringed, send a notice under Section 2;
- you can also email support@codyreading.com with a link to the Cody shop and to your store on the other marketplace. We may freeze the shop while we review ownership.
If two or more shops claim the same store on another marketplace, we may freeze all of them until ownership is resolved.
6. Repeat Infringer Policy
We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe copyrights.
- Each sufficiently supported infringement notice that is not withdrawn, successfully countered, or otherwise found mistaken may count as a strike against the account that posted the material. Several items identified in one notice may count as one strike.
- An account that receives three (3) strikes within any twelve (12) month period will be terminated, and its shop removed.
- We may terminate an account after fewer strikes, or after a single notice, where infringement is willful or flagrant, such as uploading resources copied from another seller, or where the account was created to evade an earlier termination.
- A strike may be removed if a counter-notice results in the material being restored, if the complaining party withdraws the notice, or if we determine the notice was mistaken.
A terminated user may not open a new account. Payouts for terminated accounts are handled as described in the Terms of Service.
7. Other Intellectual Property Complaints
For complaints about trademarks or other rights that are not copyrights, such as a resource that uses your brand, characters, or name without permission, email support@codyreading.com with your contact details, a description of your right, and the location of the material. These complaints are handled under our Terms of Service, not the DMCA procedures above.
